Acceptance
By using InsightMaps, you agree to these terms. If you do not agree, do not use the service.
Eligibility
To use InsightMaps, you must:
- Be at least 18 years old, OR
- Be at least 13 years old with parental/guardian consent
- Have the legal capacity to enter into a binding agreement
By using the service, you represent that you meet these requirements.
Service Scope
InsightMaps provides map viewing, analysis support, and layer management tools for general reference purposes.
Data Accuracy and Usage
InsightMaps aims to provide reliable geospatial information and analysis tools. However, users should be aware:
- Data Sources: We aggregate data from multiple sources which may vary in accuracy, currency, and coverage
- Intended Use: The service is designed for general planning, analysis, and visualization purposes
- Verification: For critical decisions (legal boundaries, construction, emergency planning, etc.), please verify information with authoritative sources
- Coordinate Systems: Data may use different coordinate systems (GDA94, GDA2020, WGS84). We strive to handle transformations accurately
We recommend using InsightMaps as part of your workflow alongside official data sources when making important decisions.
User Responsibilities
You agree to:
- Use the service lawfully
- Respect source data licenses
- Avoid misuse or disruption of the platform
- Avoid attempts to access restricted areas without permission
- Comply with all applicable export control laws
- Not use the service to facilitate prohibited or unlawful activities
Specifically prohibited:
- Automated scraping or data mining without permission
- Circumventing security measures or rate limits
- Creating accounts through automated means (bots)
- Sharing account credentials with others
- Using the service to infringe others' intellectual property
- Uploading content that violates laws (defamatory, obscene, illegal)
Content Uploads
When uploading files (such as shapefiles or other geospatial data):
- Ensure you have the right to use and share the data
- Respect third-party data licenses and intellectual property
- Avoid uploading sensitive personal information unless necessary
- Keep files free from malware or malicious code
We implement security measures to protect uploaded content, but you remain responsible for the data you upload.
Intellectual Property
Your Content
- You retain ownership of content you create or upload
- You grant InsightMaps a limited, non-exclusive license to:
- Store, process, and display your content to provide the service
- Make backup copies for service reliability
- Aggregate anonymized usage data for service improvement
Platform Content
- InsightMaps owns the platform, interface design, and proprietary features
- Third-party map data is licensed from original providers
- User-generated content remains your property
Copyright Infringement
- Do not upload content you don't have rights to use
- We respond to valid DMCA takedown notices at: [email protected]
- Repeat infringers may have accounts terminated
Feedback and Suggestions
Any feedback, suggestions, or ideas you provide to InsightMaps:
- Become the property of InsightMaps
- May be used without compensation or attribution
- Do not create confidential or proprietary obligations
- May be implemented, modified, or shared at our discretion
Attribution Requirements
When sharing outputs from InsightMaps (maps, analysis results, screenshots):
- Base Maps: Include attribution required by Esri (usually "Powered by Esri")
- Government Data: Follow attribution requirements of source agencies (see data metadata)
- InsightMaps Platform: Not required, but appreciated ("Created with InsightMaps")
Esri Attribution — Non-Negotiable:
- Every application built with the ArcGIS Maps SDK must display "Powered by Esri" text, regardless of whether Esri-hosted services are used.
- Maps using Esri basemaps or data services must additionally show data source provider attribution (third-party providers whose data Esri incorporates).
- The SDK includes a built-in Attribution widget at the bottom of every map view. Removing or hiding this widget violates Esri's Terms of Use.
- For non-map features that use Esri services (e.g., geocoding without a visible map), "Powered by Esri" must still appear somewhere visible in the interface.
User Responsibility: You are responsible for identifying and complying with attribution requirements for data layers you enable. InsightMaps provides attribution information where available to help you meet these requirements.
Note: Proper attribution protects both you and data providers. If you're unsure about attribution requirements, check the data source documentation or contact us for guidance.
Esri Master License Agreement Obligations
By using InsightMaps, you acknowledge that the ArcGIS Maps SDK for JavaScript is governed by the Esri Master License Agreement. The following restrictions apply to all users:
- AI/ML data use: You may not use Esri-sourced data (basemap imagery, geocoding results, routing data) to train artificial intelligence or machine learning systems outside of Esri's Software and Online Services.
- Open-source licensing: You may not combine Esri technology with copyleft open-source licenses (such as GPL) that would require Esri code to be disclosed, licensed for derivative works, or redistributed at no charge.
- Redistribution: You may not redistribute, resell, or provide third-party access to the ArcGIS SDK or Esri services as standalone products. Building applications that use the SDK ("Value-Added Applications") is permitted.
- No modification: You may not modify, decompile, reverse-engineer, or create derivative works of the SDK.

Service Availability
We strive to maintain reliable service, but like all online platforms:
- Service availability may be affected by maintenance, updates, or technical issues
- Features and data layers may change as we improve the platform
- Performance may vary based on your device, browser, and network connection
Australian Consumer Law:
Nothing in these terms excludes consumer rights under the Australian Consumer Law or other mandatory statutory protections. You may have additional rights that cannot be excluded by these terms.
Beta Features and Experimental Functionality
InsightMaps may offer beta or experimental features marked as "Beta", "Preview", or "Experimental":
- These features are provided "as-is" without warranty
- Features may change or be discontinued without notice
- Data processing quality may vary
- Not recommended for production or critical use cases
By using beta features, you acknowledge these limitations.
Limitation of Liability
To the extent permitted by law:
- InsightMaps is not liable for indirect damages or losses arising from service use
- Our liability is limited to the amount you paid for the service (if any) in the past 12 months
- This does not affect consumer rights under Australian Consumer Law
Indemnification
You agree to indemnify and hold harmless InsightMaps, its officers, and service providers from any claims, damages, losses, or legal costs arising from:
- Your violation of these Terms of Use
- Your violation of third-party rights (copyright, privacy, data licenses)
- Your use of the service for unlawful or unauthorized purposes
- Content you upload or create on the platform
This indemnification survives termination of your account.
Account Termination
By You
You may close your account at any time by contacting support.
By InsightMaps
We reserve the right to suspend or terminate your account immediately, without notice, if:
- You violate these Terms of Use
- Your account is used for unlawful, fraudulent, or malicious activity
- Your usage threatens service security or stability
- We are required to do so by law or court order
- The service is discontinued
Termination does not waive any rights or remedies available to InsightMaps.
Effect of Termination
- Your access to the service will be revoked
- User-generated content will be deleted within 30 days after account closure
- You remain liable for any violations that occurred before termination
Note: Some information may be retained as required by law or for legitimate business purposes (fraud prevention, dispute resolution) as outlined in our Privacy Policy.
Security Incidents
In the event of a data breach affecting your account:
- We will notify affected users via email within a reasonable timeframe
- Notifications will include the nature of the breach and recommended actions
- We will cooperate with regulatory authorities as required by law
- No guarantee of compensation is implied for breach-related losses
Export and Data Transfer
If you share or export geospatial data internationally, please be aware:
- Some data may be subject to export control regulations
- Ensure cross-border data transfers comply with applicable laws
- Do not use the service for prohibited activities
For most general users, these restrictions won't apply to your normal use of InsightMaps.
Third-Party Services
InsightMaps may connect to outside services for sign-in, hosting, and source data. Those services follow their own terms and policies.
Privacy
Use of InsightMaps is also governed by the Privacy Policy.
Changes to Terms
We may update these Terms of Use from time to time. When we make significant changes:
- We will notify you via email or prominent notice on the platform
- The "Last updated" date at the top will be revised
- Continued use after notification constitutes acceptance of the new terms
- If you do not agree to the changes, you must stop using the service
For minor corrections or clarifications, we may update terms without notice.
Dispute Resolution
Before initiating legal action, you agree to:
- Contact us at [email protected] with a detailed description of the dispute
- Attempt to resolve the matter through good-faith negotiation for 30 days
- If unresolved, disputes will be settled in the courts of Tasmania, Australia
Nothing in this clause prevents either party from seeking urgent injunctive relief.
Force Majeure
InsightMaps is not liable for failure to perform due to causes beyond reasonable control, including natural disasters, internet outages, cloud provider failures, cyberattacks, government actions, or other force majeure events.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
Entire Agreement
These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and InsightMaps regarding use of the service. They supersede any prior agreements or understandings.
Governing Law
These terms are governed by the laws of Tasmania, Australia.
